TERMS & CONDITIONS

1 BASIS OF CONTRACT

The submission of the booking form constitutes an offer by you to let the Property from Lucy Graham in accordance with these Terms and Conditions and the House Terms and Conditions. Your booking shall only be deemed accepted upon receipt of the deposit and written acceptance of the booking by us and on which date a contract shall come into existence (the “Contract”). The Contract and any documents referred to in it will constitute the entire agreement between us. This Contract shall be governed by and construed in accordance with English law and subject to the exclusive jurisdiction of the English Courts.

This Contract is made for the purpose of a holiday and is not intended to create the relationship of landlord and tenant between us.

 

2 PAYMENT

A booking deposit as set out in the booking form is payable if the booking is made more than six weeks before the date the Holiday Period commences (“Commencement Date”). The balance of the Booking Price and a Cautionary Deposit (see 3 below) is payable six weeks before Commencement Date. Non-payment of the balance of the Booking Price on or before the due date shall be construed as a cancellation of the Contract by you. For bookings made less than six weeks before the Commencement Date, the Booking Price and the Cautionary Deposit is payable on submission of the booking form. 3 DAMAGE DEPOSIT

The amount of Cautionary Deposit is set out in the House Terms and Conditions. You are required to comply with the obligations detailed in paragraphs 10 and 11 below during the holiday period. We will deduct from the Cautionary Deposit the cost of remedying any breach of these obligations together with the cost of any service or goods provided. The balance of the Cautionary Deposit will be refunded to you promptly following the end of the Holiday Period.

 

4 CANCELLATION

Any cancellation made by you for whatever reason shall be in writing and addressed to Lucy Graham, Lingy Acre, Portinscale, Keswick, Cumbria CA12 5TX or email stay@pippin-cottage.com We will endeavour to re-let the Property.

If we are unable to re-let, the full balance owing will remain payable by you or the monies paid will be forfeited (as applicable) and the deposit will not be refunded.

If we only succeed in re-letting the Property for part of the Holiday Period we shall refund an amount equal to the money paid less the rental for the period which is not re-let.

If we succeed in re-letting the Property for the whole of the Holiday Period we shall refund an amount equal to the money paid less an admin fee of £20.

We strongly recommend that you take out Cancellation Insurance.

 

5 CHANGES OF DATE

We may at our discretion agree to change the dates of the Holiday Period upon receipt of a written request from you. If the dates of the Holiday Period are not changed the booking will remain in place and all monies will remain due.

 

6 PERIOD OF HIRE

Check-in and check-out times are set out in the House Terms and Conditions.

 

7 NOISE POLICY

The noise policy as set out in the House Terms and Conditions must be adhered to at all times during the Holiday Period.

 

8 USE OF PROPERTY

The number of persons occupying the Property must not exceed the maximum number of 4. The types of groups occupying a Property must comply with the House Terms and Conditions. The Property will be used for personal and domestic purposes only. The property shall not be used for any commercial purposes without our written consent. We reserve the right to refuse entry to the entire party if these conditions are not observed.

 

9 COMPLAINTS

Should there be any cause for complaint during the occupation of the property it must be notified promptly to us and in case of serious problems confirmed in writing.

 

10 BREAKAGES OR DAMAGE

In the event of breakages, damage or the need for additional cleaning you shall reimburse us for replacement, repair or extra cleaning costs incurred. These costs will be deducted from your Cautionary Deposit, but are not limited to that amount. You will be invoiced for any costs above the amount of the Damage Deposit.

 

11 CARE OF THE PROPERTY

You shall not cause any damage to the Property including its grounds. You shall keep the Property and its furnishings, pictures, kitchen equipment and all other fittings and effects in good and clean condition. You shall be responsible for repairing any damage.

 

12 PETS

Guests must adhere to the pet policy as set out in the Terms and Conditions.

Guests may bring a maximum of 2 dogs.

 

13 NO SMOKING POLICY

All our properties are entirely non-smoking.

 

14 LIABILITY

We (for ourselves, employees and agents) shall not be liable to the Client or third parties for any accident, damage, loss, injury, expense or inconvenience, which may be suffered, incurred, arise out of or in any way connected with the letting. No term of the Contract is enforceable under the Contracts (Rights of The Third Parties) Act 1999 by a person who is not a party to the Contract. If the Property becomes unavailable or unusable for some reason prior to the date of a booking, then our obligation will be to (1) use our best endeavour to find a suitable alternative property, or failing which (2) to reimburse you for any monies paid.

 

15 WARRANTIES

We do not warrant and are not responsible for the accuracy of any verbal information given or statements made by its staff.

 

16 WEBSITE AND ADVERTISEMENTS

We aim to ensure that the information and descriptions provided are accurately conveyed on the official website and any authorised third-party websites or advertisements. There may be small differences between the actual accommodation and its description as we are always seeking to improve services and facilities. Occasionally, problems mean that some facilities or services become unavailable, and if this is the case we will tell you as soon as reasonably practical after we have been made aware of the situation. Similarly we cannot accept responsibility for any changes or closures to local area amenities or attractions mentioned on the website or advertised elsewhere.

 

17 RIGHT OF ENTRY

We shall be allowed the right of entry to the Property at all reasonable times for purposes of inspection or to carry out any necessary repairs or maintenance.

 

18 CHILDREN

You must accept responsibility for the safety of your children.

 

19 CANCELLATION INSURANCE

Cancellation Insurance is strongly recommended.

 

20 PRICING

We reserve the right to change the advertised prices of our properties at any time without prior notification. We will confirm the price of your holiday at the point of booking and the price agreed for the Property (excluding any extras), as specified on the booking form will remain firm and will not be changed under any circumstances.
